SINGAPORE : The High Court has made it clear that there can be no
excuse for anyone to throw killer litter out of his flat.
Justice V K Rajah said as long as a person can tell right from wrong, he
will be jailed.
The judge made this point during an appeal by pizza delivery boy, Tan
Kwan Sin, 21, who had been sentenced to six weeks' jail for throwing the
leg of a chair out of his flat on January 31.
The 37-centimetre long piece injured a passer-by below who did not
require medical attention.
Tan's lawyer asked the court to sentence Tan to probation instead of a
jail term because he had an IQ of 87 and was under stress as his parents
were going through a divorce at that time.
Justice Rajah said it was pure luck that Tan's act had not caused a more
serious injury.
Although Tan was "not the brightest bulb in the box", he knew right from
wrong and could hold down a job.
Justice Rajah, however, acknowledged that the six-week sentence by the
district judge was excessive and reduced Tan's sentence to three weeks
in prison.
